1. ACCEPTING THESE TERMS

This document and the other documents that we reference below make up our house rules, or what we officially call our Terms and Conditions (the “Terms”).

These Terms set out your rights and responsibilities when you view, access or use the Momentum Live paywall platform (the “Platform”) and related online services provided through the Platform (the “Services”) in connection with the purchase of access to certain copyrighted content, materials and proprietary information (“Premium Content”) made available by third party owners of such Premium Content (a “Content Provider”) on their website (the “Content Provider Site”). The Platform and the Services collectively are referred to as the “Offering”.

The Platform is owned by Momentum Live, and for the purpose of these Terms, the terms “we”, “us”, “our” refer to Momentum Live. “You” refers to you, as a “User” of the Offering (or any part thereof).

2. ADDITIONAL TERMS

  • Content Provider Terms: The Content Provider may require you to accept their own terms on the Content Provider Site which govern your use and access to Premium Content.
  • Third Party Software Terms: To view certain Premium Content, you may need to download and install third-party software, subject to that provider’s license.

3. MOMENTUM LIVE ACCOUNT

  • a. Your User Account: You’ll need a user account to purchase and access Premium Content.
  • b. Managing your Account: Log in via the Platform to update your details at any time.
  • c. Account Rules:
    • (i) Provide accurate information and do not impersonate others.
    • (ii) You are responsible for all activity on your account.
    • (iii) Keep your password secure and confidential.
    • (iv) Contact us immediately if you suspect unauthorized access.

4. ORDER PROCESS

  • a. Order Acceptance: We’ll email you when payment is received and access is granted.
  • b. Payment Issues: If payment fails, we’ll notify you to resolve it promptly.

5. ACCESS TO OFFERING

  • a. Ownership: All Platform content is owned or licensed by Momentum Live or its providers.
  • b. License: You receive a limited, revocable license to access and use the Platform under these Terms.
    • (i) Do not violate laws or infringe IP rights.
    • (ii) Do not reverse-engineer or scrape the Platform.
    • (iii) Do not introduce malicious code or disrupt services.
    • (iv) Do not reproduce or exploit content beyond these Terms.
  • c. Suspension: We may suspend services for maintenance, legal changes, or emergencies.
  • d. Content Removal: Harmful or non-compliant Premium Content may be removed.
  • e. Updates: We may update the Offering; you can request a refund if you object.
  • f. External Links: We are not responsible for third-party sites linked from the Platform.

6. PAYMENTS

  • a. Fees: You agree to pay all charges at the rates in effect when you purchase.
  • b. Payment Methods: We support various third-party payment providers.
  • c. Subscriptions: Subscriptions renew automatically; you can cancel anytime.

7. REFUNDS

  • All ticket purchases are non-refundable. In limited cases, if an event is canceled (at our discretion), we will refund the face value of the ticket. By purchasing a ticket, you agree not to attempt to circumvent refund policies. Should you dispute a charge after the show was streamed, we reserve the right to refuse future ticket purchases.

8. TERMINATION

  • a. Cooling-Off: You have 14 days to cancel unless content is accessed.
  • b. Provider Rights: We may terminate for non-payment or breach.

9. ISSUES WITH PREMIUM CONTENT

For content issues, contact our Support Center.

10. LIABILITY

We are liable for foreseeable losses caused by our breach; not for unforeseeable or user-caused issues.

11. FORCE MAJEURE

Delays due to events beyond our control will be communicated; no compensation unless substantial.

12. DISPUTE RESOLUTION

Contact our Support Center first. These Terms are governed by English law.

13. OTHER TERMS

  • We may transfer rights; you can terminate if unhappy.
  • You cannot assign your rights without our consent.
  • No third-party rights under these Terms.
  • If any part is invalid, the rest remains effective.
  • Delayed enforcement does not waive our rights.
